Singt der echte Michael Jackson auf den posthum veröffentlichten Songs „Breaking News“, „Monster“ und „Keep Your Head Up“ oder ist alles fake? Die Nachlassverwaltung und Sony Music Entertainment wehren sich gegen einen Entscheid zugunsten der Klägerin.
Mit am 11. April 2018 eingereichten Gerichtsdokumenten (hier als PDF auf http://www.themjcast.com/casciocase/19.pdf) beantragen die Beschuldigten, die Teile des Gerichtsbeschlusses rückgängig zu machen, die den Anti-SLAPP-Antrag ablehnten.
(SLAPP ist die Abkürzung für eine „strategic lawsuit against public participation“. Mit einer „strategischen Klage gegen die Beteiligung der Öffentlichkeit“ werde gemäss diesem Wikipedia-Eintrag beabsichtigt, Kritiker einzuschüchtern und zum Schweigen zu bringen, indem diese mit den Kosten einer Rechtsverteidigung belastet werden.)
In den neuen Dokumenten wird damit argumentiert, dass die Klage von Vera Serova keine Chance auf Erfolg habe, da die Behauptung des Album-Covers – Michael Jackson singe die Songs – „expressiv“ und verflochten mit der Covergestaltung sei und „keine Stellungnahmen dazu enthält, wer die Lead-Vocals auf den Cascio-Songs gesungen hat.“
Das „Michael“ Album, das im Jahr 2010 veröffentlicht wurde, enthält zehn Songs. Die Authentizität von drei dieser Songs wird angezweifelt.

Sehr gut diese Bestätigung. Man wurde ja teilweise aus gelacht. Diese 3 Songs haben mir das ganze Michael Album verdorben. Das habe ich zwar, ist aber noch original verschweißt.

Die drei angeblichen Fake-Songs wurden im Jahr 2010 auf dem posthumen Album „Michael“ veröffentlicht. Bereits kurz vor Release teilte ein Sohn von Tito Jackson mit, dass ihr Onkel nicht auf allen Songs zu hören sei. Nur ein Teil der Fans glaubte dem 3T-Mitglied, das einst unter Michaels Label „MJJ Music“ die Songs „Why“ und „I Need You“ mit ihm sang.
Fan Vera Serova war überzeugt, dass die Songs nicht von Michael gesungen sind und hat deshalb im Juni 2014 mutig eine Klage eingereicht – nachdem die Gerüchte von offizieller Seite dementiert wurden. Zuletzt hatte Anwalt Zia Modabber argumentiert, dass Sony ein Album dennoch als „Michael Jackson Album“ verkaufen könne, wenn auch möglicherweise nicht alle Vocals von Michael Jackson seien.
Am 21. August haben Sony und der MJ Estate nun eingeräumt, dass die Songs „Breaking News“, „Keep Your Head Up“ und „Monster“ tatsächlich von einem Nachahmer und nicht von Michael Jackson gesungen werden, ist auf hiphop-n-more.com zu lesen.
Die Aussage soll ihren Einspruch gegen die Klage an sie stützen. Die Worte seien jedoch hypothetisch gemeint, berichten andere Fans. Die drei Richter im Fall haben nun innert 90 Tagen zu entscheiden, ob die Nachlassveraltung und Sony als Angeklagte entlassen werden oder nicht. Es wären dann nur noch die Co-Writer der Songs, James Porte und Eddie Cascio, die angeklagt bleiben.
Zia Modabber, der Anwalt vom MJ Estate und Sony, hatte versucht, die alleinige Schuld auf James Porte und Eddie Cascio zu schieben, da diese sofern die Songs Fake seien „es versäumt haben, Sony oder dem Nachlass zu offenbaren, dass Michael die Lead-Vocals nicht geliefert hat.“
Sony Confesses To Releasing Fake Michael Jackson Music
Three songs, ‘Breaking News’, ‘Keep Your Head Up’ and ‘Monster’ appeared on Michael Jackson’s first posthumous album, Michael in 2010. It debuted at number 3 on the Billboard 200 with first-week sales of 228,000 units. Some fans were skeptical when Epic Records and Sony Music Entertainment released the album and claimed that some of the tracks were not performed by Michael Jackson but by an impostor. Katherine Jackson, Michael’s mother, concurred.
In 2014, fan Vera Serova brought a Class Action lawsuit against Michael’s longtime friend Eddie Cascio and his brother's production company, Angelikson Productions LLC, accusing them of producing fake songs and then selling them through Michael’s estate and Sony Music Entertainment. James Porte, a supposed co-writer of twelve controversial songs of Michael’s including the three stated above, was also named in the case. Eddie and James claimed that these songs were recorded in James’ New Jersey basement in 2007 but failed to provide any concrete evidence to support it. Vera argued In a Los Angeles Superior Court that the songs were fake and performed by an impersonator, Jason Malachi. Vera claimed several inconsistencies in the manner these songs came to fruition, which is supported by a 41-page report by forensic audiologist Dr. George Papcun, who concluded by research that the songs were not sung by Michael.
Vera had several pieces of evidence based on concern from Michael’s support team that the three songs didn’t include the legendary singer’s signature foot taps and finger snaps.
Sony tried to defend itself and asked Eddie and James to provide alternate vocal takes of these songs. They stated they were deleted. Vera also said that Sony Music and Eddie had been trying to delete evidence of any wrong-doing to ensure the media didn’t notice.
In December of 2016, lawyers for Sony Music and the estate finally conceded that the songs might actually be fakes. They said that Sony and the Estate had taken Eddie and James at their word and failed to make their own investigation.
The argument was not accepted by the presiding Judge Ann I. Jones of the Los Angeles Superior Court. “What is problematic is that you are ripping people off under your admitted facts,” she said. Zia Modabber, the lawyer for Sony and the Estate, tried to shift the blame on the co-defendants Eddie and James by saying that they “failed to disclose to Sony or the Estate that Michael Jackson did not provide the lead vocals.” Judge Jones did not agree with Zia’s argument: “I think what he is saying here is. ‘We were as duped as the Plaintiffs. We didn’t know you guys were recording stuff in a basement that wasn’t recorded by Michael. You told us it was Michael. We believed it was Michael. And if there is a bad guy here, who was engaging in false commercial speech, it’s not us.’”
Sony and the Estate appealed the ruling, and on August 21, 2018 the California Court of Appeal heard the oral argument in the appeal where Sony Music conceded that the three songs ‘Breaking News’, ‘Keep Your Head Up’ and ‘Monster’ featuring 50 Cent was indeed performed by an impersonator and not Michael Jackson. They did this for the purpose of the current argument on appeal. They argued they had the right to sell the songs as Michael Jackson’s even if the iconic artist wasn’t the singer. The three judges in the case have to now decide on the matter. They have 90 days.
This stage is just an intermediate appeal of Sony and the Jackson Estate’s First Amendment defense. The Court of Appeal will decide whether they should stay as defendants in the case or should be dismissed and allowed to continue selling the album deceptively. The case against Cascio brothers is very strong but the court has to make an important decision regarding Sony’s involvement in the fraud. If the court decides Sony’s part as “non-commercial speech,” they will be let off as defendants and the case against Cascio brothers will move further.
Sony is arguing that the songs were provided to them by the Cascio Brothers and James as original Michael Jackson songs which they believed good faith.
Note: Commercial speech is the advertising of a product or service through printed materials, broadcast or the Internet. It is a commercial speech when your competitor blatantly lies in its advertising about the effectiveness of its products.

Im Internet kursieren sieben weitere „Cascio“-Songs, die gemäss unseren Informationen damals nebst „Breaking News“, „Keep Your Head Up“ und „Monster“ von Sony und dem MJ Estate gekauft wurden. Die Stimmen darauf klingen ähnlich suspekt. Es wird gemunkelt, dass der tatsächliche Sänger Jason Malachi und die Stimme digital bearbeitet sei, damit sie sie wie die des King of Pops klinge. Bisher wurden diesbezüglich vor Gericht keine Beweise oder Gegenbeweise erbracht. Dies folgt erst. Eddie Cascio und James Porte behaupteten, dass sie sämtliche Vocal-Outtakes gelöscht hätten, um Platz auf ihren Festplatten zu machen. Es sollen auch keine Videoaufnahmen oder Fotos von den Aufnahme-Sessions existieren, die im Jahr 2007 bei den Cascios in ihrem privaten Home-Studio stattgefunden haben sollen. (Michael Jackson war mit der Cascio-Familie seit den frühen 1980er-Jahren befreundet.)
Viele Fans irritiert, dass MJ-Songs aus professionellen Studios mehrheitlich unvollständig eingesungen sind, während die angeblich in dem Amateur-Studio der Cascios aufgenommenen Titel bis auf die Backgroundvocals komplettiert wurden.

Der Oberste Gerichtshof von Kalifornien hat Vera Serovas Antrag auf Überprüfung gegen Sony Music and the Estate bezüglich der Werbung und des kommerziellen Vertriebs der drei Cascio-Titel auf dem MICHAEL-Album von 2010 erteilt.
Wenn Sony und das Estate im vergangenen August vom Berufungsgericht erfahren hätten, dass sie durch den First Amendment geschützt werden könnten, obwohl es nicht darum ging, wer die Stimme bei den Aufnahmen von Breaking News, Monster und Keep Your Head Up Titeln hatte, hätten die Richter nun entschieden, dass diese Entscheidung in den Augen des Gesetzes problematisch sei, da sie indirekt Unternehmen ermächtigen würde, eine nicht-authentische Kunstform zu bewerben und zu verkaufen.

Dieses Gespräch wurde dann per Screenshots gespeichert, und als die Frage via Twitter an Vera Serova gestellt wurde, ob sie über diese Kommentare auf You Tube informiert worden sei, bestätigte Vera, dass ihr Anwaltsteam direkte Beweise habe, und zwar auf der Grundlage einer Korrespondenz mit dem Anwalt von Jason Malachi.
Es bleibt die Frage, was das für den Fall bedeutet. Aber die Tatsache, dass der Anwalt von Serova und der Anwalt von Maleachi in Kontakt standen und dass dieser Kontakt es ermöglichte, einen "direkten Beweis seiner Beteiligung"; an den Liedern zu erhalten, zeigt einmal mehr, dass dieser Fall zwar noch lange nicht abgeschlossen ist, aber große Hoffnungen in Bezug auf sein Ergebnis bestehen.

Vera Serova möchte im Namen aller Michael Jackson Fans Sony Music und die Nachlassverwaltung zur Rechenschaft ziehen, da sie und ihre Experten überzeugt sind, dass die Tracks „Keep The Head Up“, „Breaking News“ und „Monster“ nicht von Michael Jackson eingesungen wurden.

As announced back in January, Sony and the Estate were “winning” the case raised by fan Vera Serova who is taking the two to court for the 3 fake songs on the 2010 album “Michael”.
However today, Vera announced on her social media that the Supreme Court agreed to review the Court of Appeal’s decision meaning that if they agree with the decision, all hope is lost to get to the truth about the 3 songs but if the Supreme Court decide to reverse the decision, the case will go to the Supreme Court to be argued again.
Vera will also have the chance to review her argument if the Supreme Court decides against the decision of the Court of Appeal.
MJ Fan vs Sony/Estate lawsuit: Sony might not be out of trouble.
Last year, we thought that the Fan that is taking Sony, The Estate and the Cascios in court regarding the 3 fake songs on the posthumous album “MICHAEL”, Vera Serova was losing the case.
But yesterday, Attorney General Becerra asked the state Supreme Court to reject Sony’s interpretation of the First Amendment related to false advertising.
Sony’s overly broad interpretation of the First Amendment fails to protect consumers by enabling companies from a wide array of industries to make false or misleading claims about their products and then declare ignorance of the misrepresentation.
Meaning that Sony might be held responsible for the 3 fake songs along with the Estate and the Cascios while last year, Sony was pretty much out of the law suite claiming they were not responsible for the fake songs as they did not record them.

The Estate and Sony Music believe the continuing conversation about the tracks is distracting the fan community and casual Michael Jackson listeners from focusing their attention where it should be – on Michael’s legendary and deep music catalog.
The fans have so much to celebrate in 2022 and beyond with regards to the vibrant legacy of Michael Jackson. We believe Michael will continue to make many new, first-time fans of all ages but it is up to all of us as the MJFam to focus on the things where we want the attention of those new to Michael’s legacy to be. We hope you share your love of Michael with the world so that the MJFam community continues to grow even further.
For instance, fans may want to continue to share the success of MJ the Musical, which won four Tony Awards including best lead actor and best choreography. Three songs from the late Michael Jackson’s 2010 album, “Michael,” were suddenly removed from YouTube, Apple Music and other streaming services. The songs have been the subject of an ongoing lawsuit against Sony Music, alleging that Jackson did not sing them.
On Wednesday, a spokesperson from Jackson’s official website addressed the issue with Behind the Mask, a Jackson fan forum run by Greg Spinks. While confirming that the three tracks were formally removed and could not be purchased or streamed by Sony Music, it “had nothing to do with their authenticity.”
“Keep Your Head Up,” “Monster,” featuring 50 Cent, and “Breaking News” — three of the 10 songs on the first posthumous album released in 2010, a year following the death of the King of Pop — are no longer posted on Jackson’s official YouTube channel. They are still available via reposts from other channels. Meanwhile, “Michael” is available on Apple Music with only seven songs. The three songs in question are no longer available for purchase. On Spotify, the three melodies are darkened in gray and unable to be streamed.
